— The following legal actions recently took place at the Sussex County Courthouse in Newton before Superior Court Judge William J. McGovern, III, according to Sussex County Prosecutor Francis A. Koch:
August 8
Francois Toussaint
Toussaint, age 26, of Brooklyn, New York, pled guilty to three counts of Forgery, a crime of the third degree and fourth degree Obstructing the Administration of the Law. Sentencing is presently scheduled for September 23, 2016.
The defendant admitted that he, along with a co-defendant, forged money orders and then cashed them at Branchville, Lafayette and Augusta Post Offices. When confronted by Hamburg Police at Hamburg Post Office he ran from the building. A foot pursuit ensued and Toussaint was caught a short time later. New Jersey State Troopers also assisted in the multi-jurisdiction investigation.
Toussaint was represented by Janine Cerra, Esq. and the State was represented by Assistant Prosecutor Brent M. Rafuse.
Judy Holgate
Holgate, age 52, of Dingmans Ferry, PA, pled guilty to fourth degree Theft. Sentencing is presently scheduled for September 23, 2016.
The defendant admitted that over a period of time from 2011 through 2016, she took $31,500.00 worth of merchandise while employed at Marshalls. At times she would return the merchandise for store credit or cash. The defendant will be required to make full restitution at sentencing.
Holgate was represented by Michelle Corbett-Rivielle, Esq. and the State was represented by Assistant Prosecutor Brent M. Rafuse.
August 5
Adam Pfeifer
Pfeifer, age 23 of Green, was sentenced to five years of probation. He was ordered to complete a substance abuse program and follow aftercare instructions, attend AA/NA meetings three times per week, submit to a TASC evaluation if required by Probation, complete an anger management program, write a letter of apology, submit a DNA sample, and pay fines and fees totaling $1,535.00.
He pled guilty on June 20, 2016, to two counts of Possession of a Controlled Dangerous Substance, a third degree crime, and Simple Assault, a disorderly persons offense.
Defendant punched and kicked another man and was in possession of cocaine on October 9, 2015, in Green Township. On February 24, 2016, he was in possession of heroin in Wantage.
Pfeifer was represented by Alexander Rinaldi, Esq., and the State was represented by Assistant Prosecutor Donald F. Cox, Jr.

Richard Jarry
Koch announced that the Sussex County Grand Jury handed up an indictment on July 28.
The indictment charges Jarry, age 36, of Newton, New Jersey, with one count of aggravated assault, a third degree crime; one count of terroristic threats, a third degree crime, and one count of possession of a weapon, a third degree crime.
The case was presented to the Grand Jury by Assistant Prosecutor Laura L. Nazzaro. Arraignment before the Superior Court in Newton will be within the next 6 weeks.
A Grand Jury indictment is a charge only. The defendant is presumed innocent until guilt may be proved at a jury trial.

David Arlington
Koch announced that the Sussex County Grand Jury handed up an indictment on July 28.
The indictment charges Arlington, age 60, of Byram, New Jersey, with one count of endangering the welfare of a child, a third degree crime.
The case was presented to the Grand Jury by Assistant Prosecutor Laura L. Nazzaro. Arraignment before the Superior Court in Newton will be within the next 6 weeks.

David Randall
Koch announced that the Sussex County Grand Jury handed up an indictment on July 28.
The indictment charges Randall, age 34, of Franklin, New Jersey, with one count of failure to notify the Franklin Borough Police Department of a change of address, as required under the New Jersey Sex Offender Act, a third degree crime.
The case was presented to the Grand Jury by Assistant Prosecutor Laura L. Nazzaro. Arraignment before the Superior Court in Newton will be within the next 6 weeks.
August 3
John Seeger
Koch announced that the Sussex County Grand Jury handed up an indictment on July 28.
The indictment charges Seeger, age 54, of Stockholm, New Jersey, with one count of possession of a weapon, a third degree crime; one count of terroristic threats, a third degree crime; one count of violation of certain person(s) not to have a weapon, a third degree crime; one count of violation of an Amended Restraining Order entered under the provisions of the Prevention of Domestic Violence Act, a fourth degree crime; one count of obstruction of law, a fourth degree crime; one count of aggravated assault, a fourth degree crime; and one count of prohibited weapons, a fourth degree crime.
The case was presented to the Grand Jury by Assistant Prosecutor Laura L. Nazzaro. Arraignment before the Superior Court in Newton will be within the next 6 weeks.
August 3
Robert Lutz
Koch announced that the Sussex County Grand Jury handed up an indictment on July 28.
The indictment charges Lutz, age 32, of Newton, New Jersey, with eight counts of forgery, third degree crimes.
The case was presented to the Grand Jury by Assistant Prosecutor Laura L. Nazzaro. Arraignment before the Superior Court in Newton will be within the next 6 weeks.
August 5
James Mitchell
Mitchell, age 42, of Vernon, NJ, was sentenced to 18 months probation with possible early termination after 9 months (contingent on good standing with probation/all fines paid), submission of DNA, continued counseling, fees/fines.
He pled guilty on May 10, 2016, to one count of Failure to Register (a Third Degree Offense).
Mitchell was represented by Steven Insley, Esq., and the State was represented by Assistant Prosecutor Laura L. Nazzaro.
