March 8 A juvenile pled guilty to third degree theft. He was adjudicated a juvenile delinquent by the court. The juvenile, age 17, of Hamburg, was sentenced to 18 months probation with 30 days detention, suspended. He must pay the victim and the victim’s insurance company a total of $3,670.95 in restitution, complete 50 hours of community service, have no contact with the victim, follow all home/school rules and graduate or obtain a GED, undergo a substance abuse evaluation and follow any and all recommendations, submit a DNA sample, complete Pathways, tour the Sussex County Jail, undergo random urine testing and write a letter of apology to the victim. On approximately Oct. 30, 2006, the juvenile, while employed as a gas attendant at the Hardyston Shell Station, took over $3,600 from his employer to support his drug habit. March 9 Martha Fendt, age 22, of Sparta, was sentenced to three years probation, 75 days jail, a substance abuse evaluation and Uisatment, two year loss of driver’s license and $3,233 in monetary penalties. She pled guilty on Jan. 16 to the third degree crime of possession of heroin, the disorderly persons offense of possession of drug paraphernalia, driving while suspended and driving while intoxicated. She admitted that in Sparta on Nov. 20, 2006, she was driving while her license was suspended and that she was in possession of a cut straw used to inhale heroin. That matter was investigated by Sparta Police Officer Richard Smith. She also admitted that on Nov. 25, 2006, in Sparta, she was stopped at a DWI check point, found to be driving while intoxicated under the influence of drugs and found to be in possession of six bags of heroin. That matter was investigated by Sparta Police Detective Marc Rubino. Patrick Mara, age 23, of Hopatcong, was sentenced to two years probation, 270 days jail, a mental health evaluation and a substance abuse evaluation, six month loss of license and $2,388 in fines. He pled guilty on Dec. 4, 2006 to two counts of third degree possession of cocaine. He admitted to possessing small amounts of cocaine on Aug. 2, 2006 and on Oct. 2, 2006 in Hopatcong. Both matters were investigated by Hopatcong Police Officer David Kraus. Timothy Herd, age 19, of Sparta, was sentenced to two years probation, 270 days jail, $1,205 in fines, a substance abuse evaluation and treatment and a six month loss of driver’s license. He pled guilty on Jan. 2 to the fourth degree crime of possessing a. device adapted or designed to defraud the administration of a drug test. He admitted to secreting a Visine bottle of urine inside of his pants when he reported to Sussex County Probation on Oct. 11, 2006 in order to attempt to defraud taking a drug test as a condition of probation. The matter was investigated by Sussex County Sheriff Department Sgt. Larry Beller. Carlos R. Barroso, age 19, of Clifton, was sentenced to 2 years probation and 150 days Sussex County Jail with a credit for 77 days. He pled guilty on March 1 to Hindering Apprehension, a fourth degree crime. He also pled guilty on Jan. 22 to Theft, a third degree crime and simple assault. Roy Teague, age 42, of Sussex, was sentenced to serve one year probation. As a condition of defendant’s probation Teague was sentenced to serve 167 days in the Sussex County Jail. He pled guilty on Jan. 22 to one count of violating his Community Supervision for Life and one count of failure to comply with Megan’s Law, both fourth degree crimes. Teague, a previously convicted sex offender, was ordered by the court to comply with the terms of Community Supervision for Life and Megan’s Law. On Jan. 22, Teague admitted to the court that on or about July 2006, he failed to notify the Andover Township Police Department that he had moved to a new address in Andover Township. He also admitted that on or about June 29, 2006 he had failed to obtain approval from his Parole Officer for any change in his address. March 12 Evan Schwartz, age 36, of Hopatcong, pled guilty to Joyriding, a fourth degree crime. Sentencing is scheduled for May 4. Richard Sweller, age 33, of Montague, entered a guilty plea to an accusation charging him with two counts of third degree terroristic threats, and one count of obtaining a prescription drug by fraud, a fourth degree offense. Sweller admitted to the court that on or about Dec. 10, 2006, he had threatened to assault an adult female and a minor child during a domestic violence dispute. He also admitted that on or about Jan. 3, he attempted to obtain Percocet with a prescription that he had altered. Trooper Chmiel and Trooper Zosche of the New Jersey State Police investigated these matters. Sweller is scheduled to be sentenced on May 4. Eric Huapaya, age 39, of Hopatcong, pled guilty to a third degree crime of Possession of cocaine. Sentencing is scheduled for May 4. He admitted to possessing a small amount of cocaine that was discovered during a brief investigation by Hopatcong Police Officer David Krause on Dec. 22, 2006. Jared Stun, age 28, of Hasbrouck Heights, pled guilty to the third degree crime, Possession of cocaine, Driving while Intoxicated and Driving while Suspended. Sentencing is scheduled for May 4. He admitted that on Jan. 1, 2006, he possessed a trace amount of cocaine, was intoxicated while operating a motor vehicle which was stopped by Sparta Police Officer Joseph Pensado and that his driving privileges have been suspended. Kurt Tandberg, age 24, of Vemon, pled guilty to a third degree crime of Absconding from Parole. Sentencing is scheduled for May 4. He admitted to leaving the State of New Jersey while he was in the Intensive Supervision Program in order to avoid being supervised. Brian Eng, age 26, of East Stroudsburg, Pa., pled guilty to a third degree crime of Possession of cocaine and a disorderly persons offense of Possession of marijuana. Sentencing is scheduled for May 4. He admitted to possessing several grams of cocaine and a little less than one ounce of marijuana following a motor vehicle stop by Hopatcong Police Officer David Krause on Dec. 9, 2006. An indictment charges Israel Garcia, age 25, of Andover, with two Counts of Aggravated Assault within a school zone, second degree crimes, two Counts of Aggravated Assault, second degree crimes, two Counts of Driving While Suspended causing serious bodily injury, fourth degree crimes and Possession of fraudulent documents, a fourth degree crime. The case was investigated by Ptl. Richard Smith of the Sparta Police Department. A Grand Jury indictment is a charge only. The defendant is presumed innocent until guilt may be proved at a jury trial. March 13 An indictment charges Edwin J. Weber IV, age 19, of Franklin with Credit Card Theft and Theft, both third degree crimes. The case was investigated by Det. Sgt. Thomas Kulsar of the Franklin Police Department. The case was presented to the Grand Jury by Assistant Prosecutor Gregory R. Mueller. Arraignment before the Superior Court in Newton will be within the next 6 weeks. A Grand Jury indictment is a charge only. The defendant is presumed innocent until guilt may be proved at a jury trial An indictment charges Erica L. Watkins, age 26, of Hamburg, with Interference with Custody, a second degree crime, and Contempt, a fourth degree crime. The case was investigated by Det. Robert Zicarelli of the Hardyston Police Department A second indictment charges Watkins with Theft, a third degree crime. The case was investigated by Det. Robert Zicarelli of Hardyston Police Department The cases were presented to the Grand Jury by Assistant Prosecutor Gregory R. Mueller. The defendant is presumed innocent until guilt may be proved at a jury trial Daniel Haubrich, age 19, of Sussex pled guilty to two counts of criminal mischief, both 3rd degree crimes. Sentencing is scheduled for May 11. On Jan. 21, 2005 in Sussex Borough, Haubrich and a co-defendant got into an altercation with a man sitting in his vehicle in a parking lot. They assaulted the victim and kicked the vehicle causing over $2,600 in damage. Both defendants were highly intoxicated at the time. On Sept. 8, 2006, in Sussex Borough, Haubrich and another co-defendant got Into a fight with another person and damaged the victim’s vehicle; that damage estimate was approximately $4,000. March 15 William Bartell, age 22, of Sparta, pled guilty to a third degree crime, Possession of Heroin. Sentencing is scheduled for April 16. He admitted to possessing two bags of heioin that were found in his wallet following an arrest on outstanding bench warrant by Sparta Police Officer McCanick.
