April 6 Heather A. Sullivan, 33, of Highland Lakes was sentenced to five years drug court probation, 45 days jail, 45 days SLAP, $705 in fines and a six-month loss of driver’s license. She pled guilty on February 9 to the third degree crime of endangering the welfare of a child and to driving while intoxicated. She admitted to operating a motor vehicle while under the influence of Ambien and to failing to adequately care for the safety of a child while under the influence. Nicholas R. O’Toole, 29, of Newton pled guilty to the third crime of attempting to defraud a drug test. He admitted to possessing a bottle of clean urine at the time that he was about to take a drug test while on probation at the Sussex County Probation Department. Kaitlyn R. Tarsa, 21, of Wantage pled guilty to the third degree crime of possession of a controlled dangerous substance and a DWI. Sentencing is presently anticipated for May 29, 2009. She admitted that on Jan. 1 she possessed 45 bags of heroin and was driving under the influence of Xanax and heroin during the course of her motor vehicle stop by Vernon Police Officer Shaun Fitzgerald. Jessika L. Carcano, 20, of Hopatcong pled guilty to fourth degree theft and third degree possession of a controlled dangerous substance. She admitted that on November 12, 2007, she helped to sell a stolen Xbox game. She also admitted to possessing a small amount of heroin on November 18, 2007. Jonathan Deluca-Knighton, 19, of Vernon pled guilty to the third crime of possession of a controlled dangerous substance and the third degree crime of attempting to defraud the administration of a drug test. He admitted to possessing a bag of heroin on November 22, 2007. He also admitted to attempting to defraud the administration of a drug test at the probation department on December 19, 2008 by possessing a bottle filled with water that he was going to attempt to use avoid giving a sample to be tested. April 13 Keith Garcia, age 28, of Bayonne pled guilty to third degree escape. Sentencing is presently anticipated for May 13. He admitted that on or about December 29, 2007, he escaped from Mountainview Correctional Facility with the assistance of Kalif Rasul who provided him with a cell phone and transportation to avoid apprehension. April 14 Steven R. Scott, 28, of Franklin was indicted with third degree theft. The Grand Jury alleges that on July 25, 2008 Scott took a parked 2008 Ford Edge from the parking lot of the Quick Chek in Franklin. Juliana Hoffman, 28, of Newton was indicted with fourth degree theft. The Grand Jury alleges that on August 18, 2008 Hoffman took $1,500 from Jean Pierson at Barrister’s Bar in Newton. Brian M. Cummins, 55, of Vernon was indicted with third degree theft. The Grand Jury alleges that during the time of March, 2006 through October, 2008, while employed as a cashier at Mac & Lindy’s Fine Wine & Spirits of Vernon, Cummins voided sales on the cash register and kept the cash for himself, totaling approximately $37,000. A Grand Jury indictment is a charge only. The defendant is presumed innocent until guilt may be proved at a jury trial. April 15 Eduardo Villalona, 21, of Hopatcong pled guilty to third degree attempting to cause significant body injury. Sentencing is presently anticipated for May 29. He admitted to punching and kicking a Hopatcong resident in the head, causing injury to the back of his head. Brian Tice, 27, of Secaucus was sentenced to five years in the New Jersey State Prison. He pled guilty on February 9 to four counts of burglary, third degree crimes, criminal attempt, a third degree crime, and conspiracy, a third degree crime. Michael Wargacki, 34, of Wantage pleaded guilty to an indictment charging him with three counts of the fourth degree charge of violating the terms of his Community Supervision For Life. Wargacki, a previously convicted sex offender, was ordered by the court to comply with the terms of Community Supervision for Life. Wargacki admitted to the court that between October 31, 2007 and November 21, 2009, he violated the terms of his Community Supervision for Life. On October 31, 2007 Wargacki consumed alcoholic beverages in violation of his terms of supervision. On November 6, 2007 Wargacki consumed alcoholic beverages and was arrested for driving while intoxicated in violation of the terms of his supervision. Between November 6, 2007 and November 21, 2007 he failed to report his driving while intoxicated arrest to his parole officer. Wargacki also admitted guilt to a separate driving while intoxicated motor vehicle offense on November 6, 2007 in the Borough of Hamburg. April 16 Denise Ackley, 46, of Hardyston was sentenced to five years state prison with 737 days credit. Defendant must register under Megan’s Law, submit a DNA sample and is subject to Parole Supervision for Life. Defendant is to attend psychotherapy and follow recommendations. Fines and costs in the amount of $2,005. Between Feb. 1, 2007 and March 20, 2007 the defendant engaged in sexual acts in front of her 9-yearold child. A juvenile, 16, of Sparta, was sentenced to 12 months probation and a six month loss of his driver’s license. He must also submit a DNA sample, undergo random drug testing, write letters of apology to the victims, get a job to begin paying for restitution capped at $10,734.50 to his victims, have no contact with his co-defendants and pay $75 in court fines. Between July and October of 2008, the juvenile and his co-defendants damaged several mailboxes, a boat windshield, boat cover, garden lamps, a school bus window and several other items throughout Sparta Township. April 17 Stephanie Szescila, 35, of Franklin was sentenced to three years probation, inpatient substance abuse treatment, 100 hours of community services and $1,338 in fines. She pled guilty on December 22, 2008 to the third degree of possession of a controlled dangerous substance and to a motor vehicle ticket for a cracked windshield. She admitted to possessing 12 bags of heroin during a motor vehicle stop in Sparta. Kathleen Dimeglio, 44, of Hardyston was sentenced to four years state prison, $1,205 in fines and a six month loss of driver’s license. She pled guilty on March 16 to the third degree crime of possession of a controlled dangerous substance. She admitted to possessing 21 bags of cocaine in Wantage on December 5, 2008. Daniel R. Brinkworth, 21, of New Found Land, Pa. was sentenced to three years probation, three days credit for time served in jail, 100 hours of community service, $1,205 in fines and a six month loss of driver’s license. He pled guilty on December 22, 2008 to the third degree crime of possession of a controlled dangerous substance. He admitted to possessing, along with his co-defendant, approximately 200 bags of heroin during the course of a motor vehicle stop on March 3, 2008. April 20 Kimberly Milner, 36, of Greeley, Pa. was sentenced to three years New Jersey State Prison and a $1,205 in fines. She pled guilty on March 23 to the third degree crime of possession of a controlled dangerous substance. She admitted to possessing 46 bags of heroin during a motor vehicle stop on April 13, 2007 by Sparta Police. Michael Salsano, 19, of Sparta pled guilty to the third degree crime of possession of a controlled dangerous substance. He admitted to possessing eight bags of heroin at the time he was arrested on an outstanding bench warrant.
